Rental Agreement

Rental Agreement:

This website is operated by Before Midnight Rentals. Throughout this site, the terms “we”, “us” and “our” refer to Before Midnight Rentals. Before Midnight Rentals offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting any aspect of 'www.beforemidnightrentals.co.nz and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms” AND "The Rental Agreement"), including those additional terms and conditions and policies referenced here. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

You agree to indemnify, defend and hold harmless Before Midnight Rentals and our owner, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

We reserve the right to alter and add to our rental terms and conditions as required. Any changes published will be effective immediately. The Renter is responsible for ensuring they're aware of the latest terms and conditions published on our website, and we recommend you update yourself on our terms and conditions before purchasing from www.beforemidnightrentals.co.nz. We are not responsible for and this is not limited to the following browsers, vendors, customers, merchants, and/ or contributors of content who are not aware of our terms and conditions not limited to this rental agreement. 

This Rental Agreement and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of New Zealand.

Renters who book postal, take home or in person try ons and book rentals are bound firmly to these terms & conditions. 

Rental Rules

Before Midnight Rentals remains the legal owner of the garment at all times. By purchasing a rental, you are purchasing the right to wear one of our garments during the agreed rental period stated on your confirmation email, invoice, receipt of rental purchase or binding rental contract. Only you, the renter is allowed to wear the rented item, no one else, it is forbidden to share the dress around with others whilst it is in your possession.

By purchasing a rental, postal try on, take home try on, or standard studio try on, you are agreeing to the terms and conditions in this rental agreement.

The name the order is placed under is legally responsible for the garment and any issues that arise during their rental period.

You are able to rent a garment for the period that has been agreed upon by Before Midnight Rentals and you the renter. All further rights to the garment expire at the end of initial rental agreement and all rented garments must be returned on time within your rental period as agreed prior to receiving your rental garment. Before Midnight Rentals remain the legal owner of the garment at all times, but you are responsible for any damage, theft or loss that may occur whilst the garment is in your possession.

It is our responsibility to provide you with a garment that is in the advertised condition on the website, any known significant faults will be under the condition section of the specific product rented. Expected rental condition, means that the garment may show signs of wear such as pulls, fraying, small repaired sections, this is expected when you are renting a garment. Any significant faults that were not advertised in the product description need to be bought to our attention within 24 hours of the garment being in your possession.

Any marks bought to our attention outside of the 24-hour period will be deemed as the customers responsibility. Any faults, marks, or damages that we Before Midnight Rentals are aware of prior to sending your garment out will be clearly specified on our website in the product description, it is your job as a renter to thoroughly read the product description. If your dress arrives in a quality less than expected and the garments quality was already specified in the product description Before Midnight Rentals will not refund or credit you if you choose not to wear the garment hired.

Rental Fees:

All garment rental fees are located on the product description on our website and are in New Zealand Dollars. This is the most up to date place that shows the rental prices of our garment. In order to secure your rental you must checkout via our website and pay in full or use one of our pay later options.

If you are unable to check out, or something goes wrong please get in contact with us immediately via info@beforemidnightrentals.co.nz and we will work to get the issue resolved asap.

Refunds:

No refunds will be issued at any point once you have placed and paid for your rental. We only offer store credits for cancellations and these must be used by the renter they are issued to, no one else.

Upon receiving your garment if you believe your garment does not match the quality level the garment was described as you must email us at info@beforemidnightrentals.co.nz within 24 hours of receiving your garment with photo evidence of the quality, damage etc. 

No refunds or store credits will be issued if the garment has arrived and does not fit properly, or if you do not like how it fits, this is the risk you take when not trying the garments on before hand. Postal Delays:

We always aim to send rentals as early as possible, if for some reason your rental does not arrive on time for you to wear to your event a full refund will be provided. If you select the delivery date as the same day as your event, and the dress arrives that day but after your event no reimbursement will be provided as we cannot guarantee when NZ Post will deliver as they can deliver as early as 5am and as late as 7pm. 

If you place a last minute order with less than 3 business days notice before your event (4 business days for rural addresses) and the garment does not arrive on time due to postal delays, no reimbursement will be offered as insignificant notice was provided to ensure the rental was sent earlier enough to avoid potential postal delays within NZ posts network. 

Cancellations:

Our cancellation policy follows the guidelines listed by New Zealand Consumer Guarantee Act which you can view here.

Once you have placed a rental you have 24 hours to request a cancellation for a refund minus a $5 payment processing fee.

If you cancel your order with more than 10 days notice of your initial rental delivery/pick up date, you will be issued a store credit with a 12 month expiry minus a 15% administration fee that is calculated off the total cost of the rental minus any try on credits used. 

If you cancel your order with less than 10 days notice but more than 4 days notice of your initial rental delivery/pick up date, you will be issued a store credit with a 12 month expiry minus a 30% administration fee that is calculated off the total cost of the rental minus any try on credit used. 

If you cancel your order within 4 days of your initial delivery/pick up date no reimbursement will be offered. 

We aim to send rentals as early as possible for rural locations this can be up to 5 days early to ensure it gets to you on time in the event of postal delays. If we have dispatched your rental and you decide to cancel it, no refund or reimbursement will be offered, once the rental has been dispatched and left our location. 

Try on credits are not refundable or transferrable if you book a rental using a store credit from a studio try on and later change or cancel your rental these will not be reimbursed in any form.

As specified under Consumer Guarantees New Zealand 

"When you buy a product or service, the sale is final unless the item breaches a guarantee under the Consumer Guarantees Act. The retailer doesn't have to give you a refund or exchange if:

  • you change your mind
  • your circumstances change
  • you find cheaper products elsewhere."

Returns:

If you book a pick up/drop off rental, your rental must be dropped back to the front door of our address on the return date you selected within the return hours set out by us:

For Saturday & Sunday returns this is between 11am and 6:30pm 

For weekdays (Monday - Friday) this is between 7:30am and 7:30pm. 

If you book a postal rental, you must post your rental back to us in the return post bag provided, handed over the counter at an offical NZ Post shop on the return by post date you selected before 4pm. Please collect the tracking receipt and do NOT return your dress in a post box as this is not for courier parcels and will be delayed, any costs incurred due to late/incorrect returns will be invoiced to you.

Incorrect returns include the following:

  • Using your own postage instead of the return post bag provided by us.
  • Using a NZ post letter drop box instead of a NZ post counter inside a NZ post shop.
  • Relying on a third party to post your rental back that results in a late/incorrect return I.e. Partner, Friend, Hall Staff, Work Postal Service or Colleague.
  • Leaving your return parcel in a letterbox for collection - Never guarantees it will be collected on time.

If you do not return your rental on the return date and/or within the specified time frame you will incur a late fee of $20 per day for each day the rental fails to be returned to us Before Midnight Rentals

If we have to cancel future rentals because you returned a garment late, you will be required to pay the full cost of the value of the future rental/rentals we had to cancel. This is a significant loss of income to us, and as we ensure the rental arrives to you on time, it is your responsibility and duty to us and the next renter/renters to ensure you return your rental on time. 

If the garment fails to return or the late fees are not paid this will be referred to a debt collection agency who will seek fees greater than what is owed to us, to cover the fee we will pay for using a debt collection agency. We will take all necessary legal action to collect owing fees.

All rentals are sent in our reusable zip lock bags these are required to be sent back with your rental regardless of whether this is a postal or pick up rental. If these bags are damaged or not returned with the rental as required you will be required to pay a $15 fee. 

Accidental Damage Cover:

This is an optional add on to your rental that costs $13.99.

Damage insurance is available for all rental garments and covers accidental damage that may occur whilst you are wearing our garment.

Damage insurance covers up to $100 worth of professional specialist cleaning OR up to $100 worth of seamstress repairs. Or up to $100 of a combination of both depending on the damage done.

Damage insurance DOES NOT COVER:

The replacement cost of the rental garment
Loss of income for future rentals
Late return fees
Loss of item due to carelessness, theft or other

If a rental garment is deemed irreparable or lost the full replacement cost is required to be paid in full. The $100 worth of cleaning/repairs CAN NOT be used as $100 off the full replacement cost. 

Damage insurance IS NOT REFUNDABLE:

It cannot be refunded through cancellation of your rental.
It cannot be refunded in the event of no damage/stainage during your rental.

If you accidentally add this to cart and checkout and pay without removing the additional damage insurance fee you will not be refunded.

Damage insurance can not be added after a rental, it must be added at the time of. booking or before the garment is shipped to you or picked up from our premises.

Additional Fees:

The rental price you pay includes minor standard cleaning which includes the removal of small marks or minor smells. If the garment is returned with alcohol, make up, fake tan, strong odours, any other dirty markings, or is damaged with rips, tears, or iron burn marks you may at the minimum incur an extra dry-cleaning/mending charge. This is determined by Before Midnight Rentals on a case-by-case basis at the time and we will invoice or charge you accordingly based on these terms and condition. If these fees are not paid to us, they will be referred to a debt collection agency who will seek fees greater than what is owed to us, to cover the fee we will pay for using a debt collection agency. We will take all necessary legal action to collect owing fees.

If the garment fails to return, is not in any usable state or is damaged beyond normal wear/repair you thereby will be held accountable to pay at a minimum 100% of the initial purchase price. This depends on whether the dress is in stock at the store we bought the dress from, including the exact size we bought, and whether the price is the same as when we purchased the garment. You will be liable to pay for any lost income caused by having to replace the rental, such as future cancelled rentals that need to be refunded.

If the above occurs, and the garment is in stock from the store we bought the garment from or is in stock at a different store in the exact size Before Midnight Rentals stocked, but the purchase price of the dress has increased, you will be held accountable for the full replacement fee including any shipping and tax costs of the destroyed garment. As well as any lost income that is incurred during the time it takes to replace the garment.

If the above occurs, and the garment is not in stock from the store we bought the garment from including the size and colour Before Midnight Rentals stocked and we therefore cannot replace the garment,  you will be held accountable to pay 150% of the initial RRP of the garment regardless of whether Before Midnight Rentals purchased the garment at a lower price. As well as any lost income that is incurred. For example if another or multiple clients have booked and paid for the rental before the garment they are renting is destroyed you will be responsible to cover the costs incurred by having to refund the client in question.

Any fees related to the above must be paid within 7 days of receiving the invoice. If payment is failed to be made, all owing debts will be referred to a debt collection agency who will seek debts greater than what is owed to cover their cost. Any and all necessary legal action will be taken to receive debts or collect an unreturned garment.
